I am wondering he is sucking her into being responsible for whatever may be left to owe. They are not married just living in my house. Help if you know???

They just want money. It doesn’t matter who pays.

I think she has a legal right to refuse paying it.

i know what kind there are but, i don’t know how much they get paid and what exactly do they do?!

Assaults Lawyer, Bankruptcy Lawyer, Compensation Lawyer, Defense Lawyer, Divorce Lawyer, Fraud Lawyer, Insurance Lawyer, Medical Malpractice Lawyer, Personal Injury Lawyer, Nursing Home Lawyer, Social Security Lawyer, Wrongful Death Lawyer, Tax Lawyer, International Lawyer, Criminal Lawyer, Securities Lawyer, Car Accident Lawyer, Malpractice Lawyer, Software Lawyer.

It would all depend on where they went to law school, where they are working ect. Lawyers at large private firms tend to make the most, whereas government lawyers tend to make less. BTW you have not even come close to naming the different types of lawyers there are and half of the list you have put together could be lumped in together (not sure if there is such a thing as an assaults lawyer, Med mal car accident and wrongful death all fall under torts/personal injury).

Am I entitled to collecting compensation for copies of medical records for a personal injury lawsuit?

When a lawyer is requesting medical records for a law suit, am I entitled to receive a reasonable fee for providing copies of such records (I am not in the law suit).
They are using it as evidence for support of damage done by another party. Can anyone site an official laws stating compensation is due?

Are you a medical professional or health care provider? If so, many jurisdictions allow medical facilities/health care professionals to charge certain fees for copies of medical records.

If you want specific laws, it would help if you gave a specific jurisdiction (i.e., state).

Can Lawyers Take Percentage From Net Settlement?

Since Lawyers are just Legal Representatives of their respective clients how can they legally take their percentage from the net of a settlement since their clients cannot and the clients must take their percentage after medical liens and lawyer expenses? Hence Lawyers are able to make 30% off their own expenses which they deduct out of the settlement money yet already have made 30% on that money.

The net proceeds are AFTER all the expenses. You seem to be referring to the GROSS amount.

A contingency agreement always is based on the gross amount of the settlement. If the court awards $100,000 and the contingency agreement is for 30%, the lawyer takes $30,000. Any other costs are irrelevant.

You could of course agree to settle for some portion of the net amount, but that must be agreed beforehand. It makes no difference, the lawyer is basing his agreement on what he sees as the outcome of the case. If the net amount of the above example was projected to be say $50,000 after medical costs, the lawyer (still seeking his $30,000) would be a fool to agree to take the case for less than 60%

People seem to fail to understand that, in a contingency case, the lawyer gets NOTHING is he loses, despite devoting hours and dollars to the case. If you agree to pay him X%, he gets x%, that’s what was agreed.

AKRON, OHIO area. My Mom has had different Doctor’s give Her medication which causes Her to have seizures. 1 will up Her dose and the others lower the doses. She has brain damage now and don’t even know that She has seizures when they happen. She keeps having seizures and I’m very upset and angry that She has to go through this. 1 Lawyer hung up on Her.

Lawyers who work on contingency basis are not going to waste time and money on cases they cannot win.

Do anyone know any Lawyers that would handle a Medical Malpractice Case that’s over it’s Statue Of Limitation?

I had my son back in 2003 at DeKalb Medical and delivered him through an Emergency C-Section, My son was born Premature and wasn’t breathing on his own also he had swallowed alot of my Bowel Movement and had several tubes going inside and out of his body, after the delivery of my son the Nurses told me he might not make it pull through I was really devastated and thought that my precious pride and joy wasn’t gone make it. My son spent 2wks inside the Special Intensive Care Unit all I could do is Pray day in and day out for the Lord to pull my son through however my son did survive through it all but what I didn’t understand is why the Doctors couldn’t tell why this took place? Well for the longest I would have these severe Headaches which cause me to close my eyes and hold my head down until they would ease up or whatnot but me being me I would just eat and maybe take some pain medication for it and lye down but this particular day I just couldn’t get rid of this Headache I was having so I set up an appointment to meet with an Physician to figure out what was causing these severe Headaches and while I was there they also did some Tests on me and the Doctor discovered some major problems that was going on in the insides of me, She stated that my Uterus was turned completely around and its connected to my Bowels and I’m thinking that that’s what caused my son to have had the problems that he had when I delivered him…Now that my son is 5yrs of age and is blind in the left eye the Case I would’ve had is over The Statue Of Limitation so I wondered if anyone could have a specific Lawyer that would take this kind of Case because ever other Lawyer that I speak with keeps telling me that its nothing that could be done because of the Statue Of Limitation on this type of Case.

if your case is beyond the statutes then there is nothing you can do……
what do you intend to sue for anyway?

if your internal problems are what caused your sons problems at birth how is that a doctors fault?

be thankful you have your son and don’t blame others or yourself for what has happened in the past.
you need to move on, look forward to the future, for your sake and especially for your son’s…….

No. Many states have implemented tort reform. California has had it for over 10 years. There are no big malpractice awards, yet no one has ever had their insurance rates go down, and malpractice insurance costs just as much there as anywhere else..

I guess they somehow think that taking away our right to sue for damage caused by incompetence or negligence is a good thing. Funny how Republicans are OK with taking away rights when it suits their agenda, and their followers are with them. Don’t they realize that someday they may be in the position of being crippled for life my a bad doctor?

If you value your rights, don’t take rights away from others.

Do doctors, nurses and lawyers read some of the medical and legal questions and give free advice?

However, there are far more people on this website who PRETEND to be doctors, nurses and lawyers than actually are. Some teenaged bimbo was on here pretending she was a doctor and she couldn’t spell well enough to be a janitor.

Nobody seems to ask WHY medical costs are so high, and why insurance costs so much. It looks to me that doctors pay through the nose for their own insurance due to ridiculous payouts on frivolous lawsuits and pass the cost on to us. Why aren’t politicians addressing the root cost of high medical costs (that is, lawyers)? How about a system that doesn’t allow doctors to be sued at all, but removes the license to practice from doctors who have X number of complaints per X months of duty? Any ideas?

Lawsuits are only a small part of the problem.

There was an interesting analysis in an article in Consumer Reports latest issue. Research done by Darthmouth Medical School showed that a communities medicare bill is determined by its supply of hospital bed and physicians, rather than medical needs. They also showed that regions of the US that spent more per capita had worse quality of care and that the outcome was no better in regions where more money is spent. The more doctors and hospitals that are available the more they have to find problems to bill for to pay for their high salaries.

One reason is greed. Dr. will perform unneeded procedures. The example was a person who had hear surgery that was un-needed. It was fraud to get money. Drs order lots of expensive test because they know the insurance will pay.

Also, there are patients who insist on the latest expensive medcine even if it is not the best for them.

Prescription meds that are under patent are expensive and not always better. All they have to do is prove the med is better than a sugar pill to get it on the market. They do not have to prove it is better than a standard med. This is lame. I’m a plant breeder and we always have to show how our plants stack up against the standard cultivars.

Do you think engineers, programmers, medical doctors, scientists,lawyers….get paid too much?

Each of those fields require a lot of education and training to get to the point where you can make ridiculous money. So maybe they are worth the pay in that sense. But teachers require just as much education to become qualified, plus their job is ostensibly more "important" than any you mentioned. Yet teachers get paid terribly in comparison. Doctors get paid a lot because we demand perfection from them (rightly so) and sue them if they slip up. We don’t sue our waiter if he messes up our order. Lawyers are overpaid because we demand perfection (perhaps wrongly) from too many other parts of society. If people stop suing companies for getting burned by hot coffee, kids choking on small parts, etc, then the financial incentives for trial lawyers will diminish. As for engineers, programmers, scientists… supply and demand I suppose dictates their salaries, so it’s hard to say what constitutes "too much" for them. Just my opinions!
