How much time after a medical procedure does one have to file a Medical Malpractice lawsuit in California

My son was born with a rare genetic disease, which caused his facial structures are under developed . During the pregnancy, my wife followed the entire necessary test.

Now we went back to the medical records and found out that the ultrasonic pictures clearly showed his deformed facial structures. However no any medical doctors told us about this, every time we were told everything is fine? Could we sue the medical doctor for her Medical Malpractice? Thanks

There’s really no such thing as "clearly" in an ultrasound, but to make your case you would have to show:
*That you had the ultrasound with the purpose of screening for ALL defects
*That the ultrasound showed the defect before the legal limit for abortion
*That you would in fact have aborted the fetus.

Chances are the ultrasound couldn’t actually diagnose the problem and a rare enough genetic test wouldn’t have shown in additional screening (not that many genetic defects have screening test). So if you had been told "there may be something potentially wrong with the baby which may be caused by any of 10/20/30 disorders" would you have had an abortion.

Really unless the doctor refuses to give you a screening test for a specific disorder, or loses or doesn’t give you the results of of the screening you really don’t have much of a case.

If you really don’t want this "defective" baby then the remedy for you is adoption.

Settlements for physical injury or illness are not taxable. However if any portion was earmarked for accrued interest or punitive damages, those portions are fully taxable as ordinary income.

Multiple states have reformed Medical Malpractice already, and they have seen very little change in health care costs.

Because real tort reform would reduce costs. Doctors currently runs unnecessary tests out of fear. The cost of those tests add up. If you can’t see that then I say you don’t want to for some reason.

Everytime anybody mentions that 45 million American’s can’t afford health care, or the fact that health costs in America rise about 15-20% every year for the last couple of decades, the right wingers always try to change the subject and start talking about "frivolous lawsuits".

One cited the McDonalds "hot coffee" case. That’s a product liability case not a Medical Malpractice case. Do some reading please. Another talks about "ambulance chasers" and "slip and fall" lawyers. Apparently he doesn’t understand that the negligence in those cases happened before the patient ever even got to the hospital, therefore those cases have nothing to do with medical malpractice either.

This is just another case of blaming victims.

I know I want to go to law school after I get my bachelor’s, but I’m still undecided as to what branch of law I’m going to study. Right about now, I’ve got it narrowed down to corporate attorney, prosecuting attorney, and Medical Malpractice attorney.
So I’m curious as to what they make, even if it’s just an average or frame.

Stay away from medical malpractice. The insurance industry successfully lobbied congress to cap medical malpractice lawsuits in order to limit their costs. Lawyers don’t make much money in that field anymore.

This is actually one of the few moves by insurance lobbyists I agree with.
