They just want money. It doesn’t matter who pays.

In my opinion, the only time malpractice suits should be for anything more than actual damages is when they stem from gross negligence or incompetence. A doctor sews a surgical instrument up in a patient, his a** is twisting in the wind.

Medicine is not a perfect science. Patients respond differently to the same treatments; doctors don’t always have all of the relevant information; decisions sometimes have to be made quickly without the aid of all possible diagnostic tests. Plus it is often difficult or impossible to know who will have what side effects.

When they are asking me to negotiate for a certain amount for a out of court settlement what is the practical way to go through the process. What are the chances that I would be getting more or less than the settlement amount in court in pennsylvania? Also am I limited to the amount of the physician’s malpractice insurance?

It would all depend on where they went to law school, where they are working ect. Lawyers at large private firms tend to make the most, whereas government lawyers tend to make less. BTW you have not even come close to naming the different types of lawyers there are and half of the list you have put together could be lumped in together (not sure if there is such a thing as an assaults lawyer, Med mal car accident and wrongful death all fall under torts/personal injury).

In California, I know the statute of limitations for Medical Malpractice is 1 year from the date of discovery of injury. I also know that the doctor must be notified 3 months in advance of the filing of the lawsuit.

What happens if the plaintiff finds a lawyer 2 months before the statute of limitations runs? How can they give 3 months notice to the doctor, and still file within 1 year?

They will likely be unable to file the claim. They should have presented notice to the doctor, even if they didn’t have a lawyer yet.

Medical malpractice? Deal with Doctor or consult a lawyer?

My friend went in for 1/2 hour outpatient procedure. When she woke up it was over 24 hours later with major surgery. spent many days in icu and missed a lot of work. The doctor made a mistake somewhere along the line. She does not want to put the doctor through the ringer, she understands it was a mistake. She does want her medical bills taken care of and I told her to get a little more to help with a mortgage, couple hundred thousand, not millions. So the question is would it be better to deal with the (doctor, hospital) or talk to a lawyer who will want to get a settlement for millions so he can make a lot of money and drive up insurance costs?

Well you can talk with the doctor. He has insurance and they will try to negotiate a settlement (out of court).
This could be good in one way…You don’t have to pay some ambulance chaser 40-50% of your settlement.
Be careful though…Malpractice insurance companies tend to send you a low ball figure hoping you will settle.
If you do settle without lawyers, get covered for later illnesses that could be because of the mistake the doctor made.

Am I entitled to collecting compensation for copies of medical records for a personal injury lawsuit?

When a lawyer is requesting medical records for a law suit, am I entitled to receive a reasonable fee for providing copies of such records (I am not in the law suit).
They are using it as evidence for support of damage done by another party. Can anyone site an official laws stating compensation is due?

Are you a medical professional or health care provider? If so, many jurisdictions allow medical facilities/health care professionals to charge certain fees for copies of medical records.

In each of those states, for a vetrinarian, it’s about $250 a year.

For all the others, it will depend on: which hospitals they have admitting priveleges to, the retroactive date on the policy, the limit of coverage, the type of medicine practiced, the type of procedures they do, the number of hours worked, the proximity to major city hospitals, How long they’ve practiced medicine, the prior claims history, and I’m probably forgetting a few other things. It can be anywhere from $500 for new dentists, to six figures for obstetricians and cardiac surgeons.
